Town Clerk's Office,
Town Hall,
Melbourne, March 1st 1865.
Sir
Referring to your letter of the 11th ultimo, requesting that in letting the grazing of the Southern portion of the Yarra Park, there should be reserved a right of passage for carts at all times into the northern portion of the Botanic Gardens, and also stating that three and a half acres or thereabouts of the ground proposed to be let by the City Council has been granted by the Government for the extension of the northern portion of the Botanical Gardens, and that it is your intention to have such piece of ground fenced in within the next three months, I have the honor to inform you that the City Council will reserve to itself the right of permitting carts to pass into or through the park where necessary during the currency of the lease to which you refer and that such permission will if desired be accorded to any carts of yours whenever it may be necessary for them to pass to or from the northern portion of the Botanic Gardens.
I am at the same time to point out that the Gardens have access to the Yarra Bank road, and that although that road is closed during formation, access can be given to you for carts at Hoddle Street by a gate in the temporary fence.
In respect to the second paragraph of your letter, I have to inform you that the City Council does not in the present instance propose to let the grazing of any land not forming part of Yarra Park.
I have the honor to be,
Sir
Your Obedient Servant
E. G. FitzGibbon
Town Clerk
Dr F Mueller
Director of the Botanical Gardens
