On 23 June 1873 the Secretary of Agriculture, A. Wallis, stated that he presumed Smith's application could not be granted 'being for mulberry cuttings'. The Assistant Commissioner for Crown Lands and Survey, Clement Hodgkinson, concurred with Wallis's opinion on 25 June, and Casey approved their recommendation on 27 June.
