The notice appeared in the Gazette, 18 October 1872, p. 1914, amended so that it appeared over the name of 'J. J Casey, Minister of Lands and Agriculture', directing application to the 'office of the Government Botanist and Director of the Botanic Gardens'.

Casey initialled M's notice on 2 October 1872 with 'the Under-signed' and 'Ferd. von Mueller, M.D.,' crossed through, and 'Govt Botanist and' inserted instead. M sent it to the Government Printer. On 18 October, J. Lascelles of the Gazette Branch in the Chief Secretary's Department, noted: 'The proper course to pursue for the purpose of processing the insertion in the Government Gazette of any Notice which the Director of the Botanic Gardens desires to be published in the Gazette is to transmit such notice to the Political Head of the Department of which the Directory of the Botanic Gardens is a Branch, accompanied by a letter requesting that such Notice may be Gazetted. The Political Head, if he approves of the notice, will then cause it to be forwarded by one of his own officers to the Chief Secretary's Department in which is vested the exclusive control of the Gazette. The annexed Correspondence belongs to and should be restored to the Department of Agriculture (Lands & Survey Office)'. M responded on 19 October: 'In accordance with the attached memorandum this correspondence is now returned to the Lands Office. Since the last 16 years my notices for the Gazette went always directly, after approval of the hon the Minister, to the Gov. Printing Office, and I was not aware that this course was contrary to any existing regulations.'
